La diputada Norma Benítez, de la Bancada Naranja, presentó una iniciativa para reformar el Código Penal de Nuevo León y sancionar con un mes o hasta dos años de prisión, y multas que van de los 4 mil a más de 14 mil pesos, a quienes abandonen a sus animales de compañía.
A partir de que el estado reconoce a los animales como seres que tienen emociones, son sujetos a protección en su desarrollo natural y salud, evitando así, el maltrato, la crueldad, el sufrimiento o cualquier otro acto que atente contra su bienestar.
Sin embargo, tras la pandemia de COVID-19, en Nuevo León se incrementaron los casos de abandono animal en un 15 por ciento, al recibir la Procuraduría Estatal de Medio Ambiente, hasta 30 denuncias diarias sobre tales hechos.
“Este tipo de maltrato o crueldad animal se ha convertido en uno de los más frecuentes, sin que exista un marco jurídico que verdaderamente sancione la conducta de las personas que negligente o dolosamente los desamparan en las calles”, dijo la Diputada Benítez.
Por lo anterior, se propone adicionar un artículo 445 TER al Código Penal local para que los dueños que abandonen a una o más de sus mascotas se le aplique de un mes a dos años de prisión y sanción pecuniaria de 50 a 150 cuotas. Dicha pena se aumentará hasta el doble si, derivado del abandono, resultara alguna lesión grave al animal doméstico.
También se sancionará por la comisión de este delito a la persona que gestione el internamiento de uno o más animales domésticos en una institución, a sabiendas que no cuenta con permiso o autorización de la autoridad competente para el cuidado de estos.
Al respecto, es de señalarse que la identificación de los presuntos infractores es posible a partir de que el artículo 15 de la Ley de Protección y Bienestar Animal para la Sustentabilidad del Estado de Nuevo León dispone que todo propietario, poseedor o encargado de animales, deberá inscribirlo en el Registro de Animales dentro de los primeros sesenta días naturales a partir de la tutela.
Finalmente, comentó la legisladora que “el objetivo de esta reforma es garantizar un trato digno a los animales, a través de una medida punitiva que más allá de un castigo corporal o sanción pecuniaria, busca crear una cultura social de protección y respeto hacia estos seres sintientes”.
